The Attorney General has been allowed to file a Preliminary Objection (PO) on the joinder of President William Ruto as a party in a petition where activist Lempaa Suyianka is challenging the appointment of 21 advisors to various government positions.
Justice Bahati Mwamuye granted the Attorney General leave to file and serve the objection, which will be limited to the question of whether the President should be joined as a respondent in the case.
“Court directs that the first respondent is granted leave to file and serve a PO limited to the question of joinder of the 1st respondent – President William Ruto – and the PO to complete by written submissions and shall be filed and served by close of business 17th of this month,” the court ruled, directing, “Written submissions by the petitioner canvassing both the respondents submissions in reply as well as the POs submissions shall be filed and served by close of business 31st of this month.”
The judge directed that the Preliminary Objection be filed and served by close of business on October 17, 2025. The petitioner, through written submissions, will respond to both the respondents’ submissions and the Preliminary Objection by October 31, 2025.
Justice Mwamuye further set December 11, 2025, as the date for judgment.
During the proceedings, Lawyer Lempaa argued that a Preliminary Objection can be filed at any stage of the proceedings, while maintaining that the President had not been sued in his personal capacity over the transactions in question.
Lempaa wants the court to issue orders compelling President Ruto’s advisers refund all the monies paid to them in salaries.
