The Court has given the Attorney General time to put in place papers in a case where the Ras Tafari Society of Kenya (RSK) has filed a case in court seeking to lift the law criminalising the use of marijuana.
The case had been listed for hearing on November 18, 2025 but the AG urged the court to postpone the matter since she had not filed responses
“Your honor I am seeking for adjournment,I cannot appear physically since I am miles away being currently in Kisumu” said Marwa.
However lawyer Shadrack Wambui representing the association objected to the application for adjournment saying that the state has been asking for an adjournment on various occasions since the matter was filed in 2021.

In this case, the Rastafarian argue that the law is unconstitutional for banning the private use of cannabis by persons professing the Rastafari faith.
The court directed that the matter be heard on the 12 January and maintain the 12th March as the judgement date.
“We will adjourn until January and maintain 12th March 2026 for judgment,” said justice Bahati Mwamuye
The matter was filed in 2021.
