Court drops KSh5.9 million car fraud cases against Khalif Kairo after settlement

A Nairobi court has withdrawn two fraud cases involving KSh5.9 million against businessman Joseph Kairo Wambui, popularly known as Khalif Kairo, following an out-of-court settlement with the complainants.

Appearing before Milimani Chief Magistrate Lucas Onyina on Monday, September 15, Kairo, through his legal counsel, informed the court that he had fully reimbursed the complainants.

“Your honour, my client has refunded the complainants through their lawyer, and they are ready to withdraw the cases,” the defence submitted.

After reviewing the submissions from both parties, Magistrate Onyina ordered the withdrawal of the charges under Section 204 of the Penal Code, which permits the termination of criminal proceedings upon mutual agreement between the parties involved.

In the first case, Kairo was accused of defrauding Dona Ayalo Okoth of nearly KSh3 million under the pretense of importing a Subaru Outback. The charge sheet indicated that between July 29 and November 16, 2024, at an undisclosed location in Kenya, Kairo—acting through his company, Kai & Karo Limited—allegedly induced Okoth to transfer KSh2,984,998 to the firm’s KCB Bank account. The promised vehicle was never delivered.

In the second case, Kairo was alleged to have defrauded Jeff Kyule Munane of KSh2,145,150 in a similar vehicle import scheme. The prosecution claimed that between July 10 and July 29, 2024, in Westlands, Nairobi, the businessman obtained the funds purportedly to import a Honda Vezel Hybrid from Japan, which also failed to materialise.

Kairo had previously denied all charges when they were first brought before the court.

The withdrawal of the two cases marks the conclusion of the fraud allegations tied to Kairo’s vehicle importation business, at least for now. However, the court was informed that a third case involving the businessman remains pending, with negotiations between the parties still ongoing. The matter is scheduled for hearing in December.
