DPP opposes bail for man serving 30-year sentence over Dusit terror attack

The Director of Public Prosecutions (DPP) has opposed a bail application filed in the Kiambu High Court by a 61-year-old man currently serving a 30-year jail term over the Dusit terror attack.

Mohamed Abdi Ali was convicted on 22nd May 2025 and sentenced on 19th June 2025 to serve an aggregate sentence of 30 years’ imprisonment for conspiring with others to commit a terrorist act and facilitating a terrorist attack at the Dusit D2 Hotel complex, Nairobi in January 2019, which claimed the lives of 21 people.

Mohamed wants to be released on bail pending the hearing and determination of his appeal, which he lodged on 27th June 2025.

The DPP, through Prosecuting Counsel Mr. Duncan Ondimu, told the court that the offences committed by Mohamed are serious and terrorism-related.

He argued that the gravity of the crimes weighs heavily against the grant of bail pending appeal, in the interest of public safety and maintaining public confidence in the administration of justice.

Mr. Ondimu further submitted that the interests of justice would be best served by prioritizing the expeditious hearing and determination of the appeal rather than granting bail on insufficient grounds.

In his response, Ondimu stated that the applicant had failed to demonstrate any irreparable prejudice he would suffer if the appeal was heard while he remained in lawful custody. He added that the DPP’s office is ready and willing to proceed with the appeal without delay.

“The applicant has not demonstrated that the appeal has overwhelming chances of success but merely expresses dissatisfaction with the findings and conclusions of the trial court.” Ondimu submitted.

Mohamed filed the application under a certificate of urgency, seeking release on bail pending appeal on medical and family grounds. The case will be mentioned on the 28th February 2026.
