DPP withdraws car theft case against car dealer Francis Ng’ang’a

The Office of the Directorate of Public Prosecution (ODPP) has withdrawn a car theft case against Nairobi car dealer Francis Ng’ang’a, his son Brandon Njoroge Ng’ang’a, and their alleged accomplice Robert Mugaa.

According to documents at Makadara Law Courts, the trio was facing charges of conspiracy to steal a motor vehicle, make Mercedes Benz S350, registration number KDS 724T, valued at KSh6.5 million, property of one Andrew Kiarie.

The ODPP withdrew the suit against Ng’ang’a, the proprietor of Valley Road Motors, his son and the alleged accomplice after the matter was settled out of court.

Makadara Principal Magistrate Gilbert Shikwe, in turn, lifted a warrant of arrest issued against the trio and the matter discharged under Section 87A of the Criminal Procedure Code (CPC).

“The accused persons are discharged, the orders issued on May 29, 2025, are hereby vacated,” Magistrate Shikwe ruled.

The court stated that the warrant was issued after they failed to appear for a plea taking, stating that they settled the matter with the complainant, a city lawyer, out of court, hence the temporary withdrawal of the matter.

“…Whereas Brandon Njoroge has this day been charged before this court for that he failed to attend court on May 28, 2025, …you are hereby commanded forthwith to apprehend the said accused and bring him before this court to answer to the said charge, and to be further dealt with according to the law.” Part of the warrant of arrest addressed to Dandora police read.

“…Whereas Francis Ng’ang’a has this day been charged before this court for that he failed to attend court on May 28, 2025, …you are hereby commanded forthwith to apprehend the said accused and bring him before this court to answer to the said charge, and to be further dealt with according to the law.” The other warrant of arrest read in part.
