Government Chemist tests did not link rally driver Maxine Wahome to Asad Khan’s death, police tell court

The murder case against rally driver Maxine Wahome resumed on Tuesday, with investigating police officer Diana Agote telling the court that the tests submitted to the Government Chemist did not implicate Wahome in the death of her boyfriend, Asad Khan.

Agote, part of the investigation team, said investigators initially sought to determine whether any toxic substances were involved in Khan’s death. Several exhibits collected from the scene, including samples from Khan’s kidney and liver, were sent for analysis.

According to the officer, she visited Khan while he was admitted to the Intensive Care Unit.

She testified that the patient had only one visible injury, with his leg bandaged, and was unable to speak.

“We were not allowed to stay for more than five minutes,” she said.

A few days later, she said, investigators were informed by Khan’s brother that he had died.

Before his death, police had intended to charge Wahome with causing grievous harm, but Khan’s death escalated the matter into a murder investigation.

Agote told the court that, police spoke to relatives from both sides as part of fact-finding. No weapon was recovered from the house.

“As to the cause of injury, we relied on the doctor’s report,” she said. “The infliction was caused by sharp trauma. It might have been caused by the suspect, or by the deceased himself, because those were the only two people present.”

She added that security guards at the apartment said there had been a fight in the house that night, and investigators believe the fatal injury was sustained during that altercation.
While being cross examined by senior counsel Phillip Murgor Regarding toxicology, Agote said all the tests she sent, including whisky samples, showed no evidence implicating Wahome.

“No tests implicated her,” she testified.

She added that Wahome was generally okay when taken into custody and that all reports received from the Government Chemist came out in her favor.

Murgor asked whether the investigation considered the possibility that Khan had intoxicated or injured himself. Agote responded that all tests had been done and sent to the Government Chemist, and the results supported Wahome.

She denied there been evidence of torture

The court was told that Maxine was charged with murder based on the initial reports.

There was nothing wrong with Maxine and her family not attending the burial because of the situation.

The court heard that the government results were obtained months after Wahome had been charged .

As per the reports the deceased had taken high off things that could make him think he could fly Nyayo house,Murgor posed

Murgor asked whether the officer did ask the DPP to review the charge even after getting the results.

” We didn’t do that “she said

Case adjourned to tomorrow Wednesday, 26th November.
