High Court blocks parliamentary suspension of Kitutu Chache South MP Antony Kibagendi

Kitutu Chache South MP Antony Kibagendi has scored a legal victory after the High Court suspended a decision by National Assembly Speaker Moses Wetang’ula to bar him from Parliament.

Justice Bahati Mwamuye issued an order staying the Speaker’s directive, allowing Kibagendi to continue carrying out his parliamentary duties pending the hearing and determination of the case.

The court also prohibited Parliament from initiating or pursuing any disciplinary action against the legislator until the matter is fully resolved.

In his ruling, Justice Mwamuye noted that the orders were necessary to maintain the status quo and prevent any actions that could render the petition meaningless.

Kibagendi had approached the court challenging his suspension, arguing that it violated constitutional provisions and was imposed without due process.

He contends that the disciplinary action infringes on his rights as an elected representative and effectively denies his constituents proper representation in the National Assembly.

The controversy arose following parliamentary proceedings in which Kibagendi was accused of engaging in conduct deemed disorderly, prompting the Speaker to invoke disciplinary measures, including suspension.

This ruling allows the MP to resume his legislative work while the legal battle continues, highlighting the judiciary’s role in ensuring checks and balances within parliamentary processes.
