High Court Judge Justice Bahati Mwamuye has issued orders restraining Kenya Railway Corporation and other parties from continuing with the implementation or procurement of the Riruta–Ngong metre gauge railway project after faulting respondents for failing to comply with court directions.
In a ruling delivered on January 20, 2026, the judge ruled that proper service had been effected on all the respondents, but they failed to give a satisfactory explanation for not filing their responses as directed by the court.
“I find that the respondents have not given a good reason as to why they failed to file their responses by December 30th 2025” said Bahati Mwamuye ,adding that non-compliance with court orders cannot be blamed on external factors.
Mwamuye held that in the interests of justice, the matter should be adjourned while interim relief is granted to preserve the subject of the dispute.
Consequently the court issued interim orders restraining the corporation, its agents and any other parties from continuing with the implementation or procurement of the Riruta–Ngong metre gauge railway project pending the hearing and determination of the application.
