High Court orders DCI boss Amin, Police IG Kanja to produce missing activist Ndiangui, dead or alive

The High Court has ordered the Director of Criminal Investigations ( DCI), Mohammed Amin, and the Inspector General of Police, Douglas Kanja, to produce the missing activist Ndiangui Kinyagia, whether dead or alive.

Justice Chacha Mwita issued the commands to the police bosses who failed to appear in court on Tuesday, July 1, 2025 to provide the whereabouts of Kinyagia, who went missing on Saturday, June 21. 

This follows through a habeas corpus application filed by the Law Society of Kenya (LSK), which sought the urgent production of Kinyagia.

Justice Mwita, in his ruling, raised concerns about how the State was managing the situation, noting that the DCI officers were the last known individuals to visit Kinyagia’s residence in Kinoo before his disappearance.

“I have heard you and read the pleadings. The DCI officers visited his residence, and they are the only ones who were there when he disappeared,” the judge said.

The Judge questioned the reliability of the State’s account, noting that the caretaker cited by police had not sworn an affidavit and could not be independently verified.

“Since DCI officers were in Ndiangui Kinyagia’s house before he disappeared, we need an explanation from DCI on where he is,” said Mwita.

This development comes after Ndiagui Kinyagia disappeared around June 21, 2025, shortly after posting controversial content online related to the June 25, 2025, protests.

The police and DCI searched his residence in Kinoo but did not find him. They seized several personal items, including laptops, mobile phones, and passports.

The High Court, through Justice Chacha Mwita, emphasized the seriousness of the disappearance, stating that “There is no way a Kenyan will get out of his home, and vanish from this world without a trace. It is not humanly possible,” he added.

Human Rights groups and activists have raised concerns about possible enforced disappearance and violations of Constitutional rights. Amnesty Kenya and other organizations have called for his immediate release.
