Judge Majanja’s parents plead for release of frozen estate funds

The distribution of the late High Court Judge David Majanja’s estate has been temporarily halted following a dispute among his siblings over the validity of his will. The court has frozen approximately KSh 22 million in estate funds pending resolution of the matter.

The disagreement arose after a will surfaced indicating that the bulk of Majanja’s estate, including bank accounts, shares, and post-employment benefits, would be managed by his youngest brother. Other siblings challenged this arrangement, claiming they were unfairly excluded from the inheritance, prompting the court to intervene.

Majanja’s parents, who had been financially dependent on him prior to his death, have reported struggling to meet daily expenses and medical costs while the estate remains inaccessible. The court is yet to make a ruling on whether partial access to funds can be granted to cover urgent needs.

The late judge, who passed away 10th July 2024, served in several High Court stations, including Kisumu, Kisii, Homa Bay, Migori, and the Milimani Civil Division in Nairobi.

He was known for his contributions to the judiciary, including active participation in committees under the Judicial Service Commission and efforts to strengthen governance and succession processes.

Legal analysts say the dispute underscores challenges in family succession, especially in cases involving high-profile figures and substantial estates.

They note that contested wills can often lead to protracted legal battles, delaying the intended distribution of assets and creating financial stress for dependents.

The court proceedings on Majanja’s estate are ongoing, and no final decision on distribution has been made.
