The Kitale Magistrate’s Court has convicted a man to life imprisonment after finding him guilty of defiling two minors, aged 10 and 9. Prosecutors Grace Rop and Jacinta Kegehi successfully secured the conviction in the case.
Evidence presented in court showed that the crimes took place between 21st June 2025 and 23rd June 2025 in Masaba area, Kiminini Sub-County.
The man, who was the girls’ stepfather, committed the offences whenever their mother was not at home, taking advantage of her absence to assault the children.
The mother told the court that her 2-year-old child alerted her to what she had witnessed ‘baba’ doing, which prompted her to investigate and speak with her older daughters.
The girls then disclosed that their stepfather had been sexually abusing them for more than two years, revealing the long-term nature of the abuse.
In their testimonies, the minors described in detail how the man ensured they were alone before assaulting them.
They explained they had remained silent due to fear of being thrown out of their home, as the accused had threatened them against speaking out about the abuse.
Five witnesses supported the minors’ accounts, while medical evidence also backed their testimonies. The medical reports revealed clear signs of recent sexual violation, confirming the girls’ statements.
The man claimed he was in Kakamega when the crimes occurred, attempting to establish an excuse. However, the court rejected this defence, noting that he failed to provide sufficient proof of his whereabouts.
His alibi could not counter the compelling evidence presented by prosecutors, particularly the girls’ reliable and consistent accounts.
Magistrate Hon. W.M. Ghati noted in her ruling that the minors had clearly identified the perpetrator, and being their stepfather, this was a straightforward case of recognition rather than mere identification.
Based on the weight of evidence presented, the court convicted the man and handed him a life sentence for each count of defilement.
