Advocate Wakili Kemboi Gilbert has clarified that he is not currently representing any party in the estate dispute of the late James Nderitu Gachagua, but is seeking to offer pro bono legal services to the widow amid the ongoing controversy.

In a press statement issued in Nairobi, Kemboi said the administration of the estate had initially followed due legal process, noting that a valid Grant of Probate had been issued and confirmed by the High Court before distribution to beneficiaries.

“The administration of the estate was undertaken pursuant to a valid Grant of Probate issued and confirmed by the High Court in accordance with the Law of Succession Act,” he said.

His remarks come at a time when the matter has drawn heightened public attention, with allegations emerging over the validity of the will, including claims of forgery, undue influence, and concerns about testamentary capacity and provision for dependants.

Kemboi indicated that while the law provides room to challenge such matters, any attempt to overturn a confirmed grant must meet strict legal thresholds.

“The burden of proof lies squarely with those alleging impropriety. Claims of forgery, fraud, or incapacity must be supported by cogent and credible evidence,” he stated.

He emphasized that succession disputes remain the preserve of the courts and cautioned against politicising or litigating the matter in the public arena.

“Succession proceedings are judicial in nature, and their resolution lies exclusively within the jurisdiction of the courts,” he added.

The advocate further urged restraint among stakeholders, noting that the integrity of the judicial process depends on allowing due process to unfold without external interference.

Kemboi concluded by expressing willingness to support the widow through pro bono representation, framing his intervention as a step toward ensuring that justice is accessible and grounded in law and evidence.
