Man sentenced to 30 years in jail for defiling his 12-year-old stepdaughter in Kwale

The Office of the Director of Public Prosecutions (ODPP) in Kwale has obtained a guilty verdict and a three-decade prison term for a middle-aged man who sexually abused his 12-year-old stepdaughter.

Resident Magistrate Ruth Ogolla delivered the judgment, declaring Mangisi Chaka Mangisi guilty of defilement under Section 8(1) read together with Section 8(2) of the Sexual Offences Act, 2006.

He was additionally found guilty of performing an indecent act on a child, violating Section 11(1) of the same legislation.

The criminal acts took place in Kayawaa village, Kwale County, between April 2021 and November 2022. Evidence presented during proceedings revealed that the accused defiled the child while she was under his care.

The abuse was exposed on January 4, 2023, when the young victim revealed what had happened to her guardian. After receiving this information, the police were notified, and the child was taken to Kwale Sub-county Hospital for medical examination, where a P3 form was filled to document the findings.

On January 13, 2023, police officers accompanied by the victim and her guardian traveled to Lungalunga, Mwamose Village, to obtain statements from persons connected to the case.

The magistrate observed that the five witnesses presented by the prosecution had provided compelling evidence that justified both conviction and sentencing.

Assistant Director of Public Prosecution Collins Orwa alongside Prosecution Counsel Mahdy Twalib handled the case for the state, and the accused taken into custody on January 22, 2023, and faced trial in court thereafter.
