The Office of the Director of Public Prosecutions (ODPP) has sanctioned charges against two healthcare facilities, their directors, and several employees after investigations revealed fraudulent claims running into millions of shillings at the Social Health Authority (SHA).
In a statement dated 4th October 2025, the ODPP confirmed that it had received inquiry files from the Directorate of Criminal Investigations (DCI) on 1st October 2025.
Following an independent and thorough review, the DPP directed that charges be instituted against St Mark Orthodox Hospital in Vihiga County and Jambo Jipya Medical Clinic in Kilifi County, together with their respective officials.
Investigations revealed that St Mark Orthodox Hospital fraudulently submitted claims worth Ksh. 4,916,800, which were irregularly paid by SHA, instead of the correct amount of Ksh. 18,000.
The hospital now faces charges of conspiracy to defraud, cheating, acquisition of proceeds of crime, and falsification of health documents.
Two of its directors, Desouza Fenley and Mark Dhilion Sydon, have also been charged individually with similar offences.
In addition, Sammy Otieno, an employee of SHA, has been implicated for colluding with the hospital and will be prosecuted for conspiracy to defraud and conspiracy to commit a felony.
The case against Jambo Jipya Medical Clinic in Kilifi County involves fraudulent claims amounting to Ksh. 2,032,680.
The institution and its directors, Patrick Kimuyu Kanya and Faith Chepkururi Bii, will face charges including conspiracy to commit a felony, fraudulent alteration of information, cheating, and acquisition and use of proceeds of crime.
Several employees of the clinic, among them Steven Okinyi Ojwang, Justine Baraka Glen, Maina Macharia, Pauline Wanjiru, and Nadia Mbeyu, have also been lined up for prosecution on various charges ranging from forgery, uttering false documents, knowingly making false statements, to conspiracy to commit a felony.
The ODPP emphasized its commitment to upholding the rule of law and ensuring accountability in the use of public resources.
“The Office of the Director of Public Prosecutions (ODPP) undertakes to continue exercising its mandate in accordance with the Constitution and relevant laws,” the statement read.
The prosecutions mark a significant step in the fight against corruption and fraudulent practices within Kenya’s healthcare sector, particularly in safeguarding the integrity of the Social Health Authority.
