Reprieve for Kisumu City Manager Michael Abala Wanga as court allows withdrawal of corruption charges

The Milimani anti-corruption court has allowed an application by the prosecution to withdraw criminal charges against Michael Abala Wanga under Section 87A of the Criminal Procedure Code.

In its submission, the Prosecuting counsel told the court that the decision to discontinue the case was made under the authority of the Director of Public Prosecutions (DPP), as provided for under Article 157 of the Constitution, which grants the DPP powers to institute and terminate criminal proceedings.

The court heard that the defence had earlier applied for a review of the charges, a process that has been ongoing since 2025. The prosecution further indicated that the accused had undertaken to settle outstanding obligations owed to the Kisumu County Government, a factor that informed the decision to seek withdrawal of the charges.

In its ruling, the court noted that it had considered the nature of the charges in the two case files, as well as the submissions by both parties. The magistrate found merit in the prosecution’s request and allowed the application.

“I shall allow the prosecution’s application to withdraw the charges,” the court ruled.

Consequently, Abala Wanga was discharged, bringing the matter to a close.

The DPP had approved charges in November 2025 following investigations by the Ethics and Anti-Corruption Commission (EACC).

Wanga had been accused of fraudulently obtaining about Ksh. 8.7 million in salaries and allowances from the Kisumu County Government after allegedly using forged academic and clearance documents to secure his appointment as City Manager.
