The Office of the Director of Public Prosecutions (ODPP) has secured a life imprisonment sentence against a man convicted of committing incest with his teenage daughter in Tana River County.
In a statement shared on its X account on March 12, 2026, the ODPP said Hussein Buya Omar, a man in his 50s, was found guilty of repeatedly abusing his school-going daughter.
The conviction was delivered by Senior Principal Magistrate Edward Too at the Hola Law Courts, who ruled that the accused committed the offence contrary to Section 20(1) of the Sexual Offences Act.
According to court proceedings, the incidents occurred on several occasions in Mkomani Village within Mazuni Location in Tana River County.
“The offence occurred on several occasions in Mkomani Village, where the accused repeatedly abused the school-going girl despite being fully aware that she was his daughter,” the ODPP said.
The prosecution team, led by Alfred Michuki and Elijah Oruko, presented seven witnesses during the trial. Among them were the minor, her mother, the area chief, a clinical officer and the investigating officer.
Medical evidence, including a P3 form, treatment notes and the child’s birth certificate, was also presented in court to support the victim’s testimony.
In his judgment, Magistrate Too said the victim’s account was reliable and consistent throughout the trial.
“The victim’s account was consistent, credible and free from malice,” he ruled.
The court dismissed the accused’s defence, terming it a mere denial, and found that the prosecution had proved the case beyond reasonable doubt.
“Consequently, the court sentenced Hussein Buya Omar to life imprisonment,” the ODPP stated.
