Two men, 47-year-old Marshal Kipkirui and 22-year-old Kelvin Kipkorir, have been arrested in Silibwet, Bomet Central, for engaging in sodomy.
The two were caught in the act inside a shop and were taken to a health facility where it was confirmed they were engaging in the act.
Under Kenya’s Penal Code, “carnal knowledge against the order of nature” is criminalized in Section 162 and can carry a sentence of up to 14 years in prison, with aggravated cases punishable by up to 21 years.
Additionally, Section 165 prohibits “gross indecency between males,” even in private, and carries a sentence of up to 5 years.
In 2019, a petition to decriminalize these provisions was dismissed by the High Court, which ruled that they were constitutional.
