Two men charged with assaulting and threatening to kill a Nairobi businessman

Two men have been charged with assaulting and threatening to kill a Nairobi businessman.

Rahiel Daud and Hitesh Motwani, also known as “Vicky,” were arraigned before Kibera Principal Magistrate Zainab Abdul, where they pleaded not guilty to the charges.

According to the charge sheet, the two are accused of assaulting Arya Anuj at Taal Club on March 25, 2026, causing him actual bodily harm. They also face a separate charge of allegedly threatening to kill the complainant during the same incident.

“On 25th March 2026, at Taal Club in Westlands within Nairobi County, without lawful excuse, uttered to Arya Anuj words to the effect that you would kill him, which words constituted a direct threat.” read count 1 of the charge sheet.

While issuing her ruling, Magistrate Abdul noted that the first count is a serious offence which attracts a heavy penalty. She ordered that a pre-bail report be prepared before bond terms can be determined.

During the proceedings, the defence raised concerns about how the accused were handled following their initial arrest. The court heard that the suspects had earlier been released on a cash bail of Sh5,000 at Parklands Police Station.

However, their lawyer claimed the accused later “went missing” under unclear circumstances before reappearing in court. The defence further alleged possible interference with investigations, suggesting that officers from the Directorate of Criminal Investigations (DCI) may have taken an interest in the case.

It was also alleged that the accused were taken to a location behind Capitol Hill Police Station and asked to record statements under unclear conditions.

The defence sought to have the plea deferred to establish the circumstances under which the statements were recorded and whether due process was followed.

The prosecution opposed the application, arguing that the charges were properly framed in line with Article 157 of the Constitution.

It also informed the court of another pending matter involving the accused related to malicious damage to property, noting that only the current charges were ready for plea.
