On March 24 and 25, 2026, two American juries delivered verdicts that stripped away the legal immunity social media giants have enjoyed for decades.
For the first time, companies like Meta (Instagram/Facebook) and Google (YouTube) were held liable not for what users post, but for how their apps are built.
1. The Verdicts: What Happened
New Mexico ($375 Million): A jury ruled that Meta’s platforms were designed in a way that actively enabled child exploitation. They found the company violated consumer protection laws by misleading the public about safety.
Los Angeles ($3 Million): A jury ruled in favor of a young woman, Kaley G.M., finding that the platforms were defective products because their algorithms were designed to be addictive thus causing her severe clinical depression.
2. The Defective Product Logic
In legal terms, this is the most important shift.
Usually, if someone is bullied on Facebook, Meta says, “We didn’t write the comment; the user did.”
The U.S. juries rejected this and ruled that the code that keeps you scrolling, i.e.,the algorithm is a product.
If a car has a faulty engine that causes an accident, the manufacturer is sued.
The court applied this same logic to social media: If an algorithm is designed to bypass a child’s self-control, that engine is defective.
3. It’s application in the Kenyan Courtroom
Kenya is currently a global hotspot for Big Tech litigation.
The U.S. verdicts provide a persuasive Soft Law which Kenyan lawyers can use in three specific ways:
The Consumer Protection Act (2012): Section 13 of Kenyan law states that services must be of reasonable quality.
A Kenyan lawyer can now argue that an app designed to cause “mental injury” or addiction is a breach of this act.
* The Data Protection Act (2019): These trials proved that Meta uses addictive profiling.
Under Kenyan law, processing a minor’s data for such purposes without strict, verifiable parental consent is illegal.
The U.S. evidence can now be used as proof of intent in Kenyan courts.
* Article 53 of the Constitution: Kenya’s Constitution mandates that a child’s best interests are “of paramount importance.”
The U.S. verdicts provide the scientific and corporate evidence needed to prove that “infinite scroll” (doom scrolling) features are contrary to a child’s best interests.
4. How a High Court Nairobi ruling already opens the door
Kenya has a unique advantage in pursuing these cases.
Because the High Court in Nairobi has already ruled that Meta can be sued locally via the Sama and Majorel content moderator cases, Kenyan parents do not need to go to California to seek justice.
5. What Could Change for Kenyan Users?
If Kenyan lawyers or the Communications Authority (CA) follow this precedent, we could see:
a) Mandatory Age Verification: Stricter “Know Your Customer” (KYC) rules for social media sign-ups in Kenya.
b) Algorithm Audits: The government could demand to see how TikTok or Instagram feeds content to Kenyan minors.
c) Local Compensation: Financial settlements for Kenyan families whose children have suffered from documented cyber-addiction or online exploitation.
These U.S. verdicts move social media harm from a parenting or household problem to a corporate crime.
For Kenya, it provides the legal ammunition to demand that Big Tech treats African children with the same safety standards as those in the West.
