The High Court has issued conservatory orders barring the police from arresting blogger Ndiangui Kinyagia.
This was after several days of disappearance, before Ndiangui showed up in court on Thursday June 3, 2025 in the morning to the relief of his family and legal team.
Ndiangui’s mother, Lilian Wanjiku, was present, as the court proceeded to determine the upcoming action following his sudden return.
Kinyagia’s lawyers described him as looking “sick and traumatized,” and was not in a position to participate meaningfully in the court proceedings.
Family’s representative Lawyer Kibe Mungai, told the court that he had been notified of Kinyagia’s presence by fellow advocate Wahome Thuku on Tuesday evening.
As stated by the lawyer, there had been a phone call between Wanjiku and Kinyagia the night before his court presence.
“Your Honour, we have him. We were looking for him, and he is finally here. But he’s not in good condition,” Kibe stated, pointing out that the family and legal team were yet to speak with him.
Kibe urged the court to allow the family time to speak to Kinyagia privately due to client’s state of mind and health and requested that the matter be suspended.
“I regret that I can’t be of any assistance until we have had a session with him to know what happened to him,” he said.
The lawyers also claimed that there is a possibility of Kinyagia being arrested, and asked the court to issue an order to prohibit any arrest. A request that was accepted by court.
He further recommended that Kinyagia be united and required to attend court whenever needed.
“Family has made a request……and that is reasonable… Then we can reconvene once he has been briefed and is ready to participate,” court was told.
Justice Chacha Mwita recognized the petitioner’s doubts, stating that the family’s request was sensible and that Kinyagia’s presence in court had fulfilled the key purpose of locating him.
“My intentions was to have him and present him to Kenyans. He is here we have him. Also it’s good to allow the family and the lawyers time to speak to him,” Mwita said.
The Attorney General, through lawyer Emmanuel Bitta noted that they have not been treated with fairness and needed a chance to be heard.
Kinyagia’s family has been given time to take him to hospital as they wait for the hearing of the matter on July 18.
