Court gives Government 14 days to file responses in petition challenging procedure used to review fuel prices

The High Court has granted the government and other respondents 14 days to file their responses in a petition challenging the procedure used to review fuel prices.

The matter came up for mention before Justice Roselyne Aburili, during which the court was informed that none of the respondents had submitted their responses to the petition.

In his submission, the petitioner, Francis Awino, stated that although the government had since reduced fuel prices, his case goes beyond the issue of cost. He emphasized that the petition seeks to address the legality and constitutionality of the process used in determining fuel prices.

Awino argued that the concerns raised in the petition remain unresolved and maintained that he could not withdraw the case simply because fuel prices had been lowered.

The activist has moved to court seeking orders to suspend the implementation of fuel prices announced by the Energy and Petroleum Regulatory Authority (EPRA) for the period between May 15 and June 14, 2026.

In the constitutional petition filed at the Milimani High Court, Awino accuses the government and energy sector regulators of breaching the Constitution by imposing what he describes as an economically burdensome measure on Kenyans without sufficient transparency or public participation.

He further contends that the fuel pricing mechanism has significant implications for the cost of living, and decisions affecting millions of consumers should involve meaningful public engagement.

The court directed the respondents to file and serve their responses within 14 days. The matter will be mentioned again on July 2 for further directions.
