The High Court has declined to review the bond terms granted to former Kiambu County Governor Ferdinand Waititu, following a request by his legal team to amend the conditions of his release.
In her ruling, Justice Lucy Junguna stated that the bond terms had been issued fairly, based on the evidence presented at the time, and would not be altered.
“I will not vary those orders. Honestly, I did the best I could based on the material placed before me. You presented material that persuaded me, and I was gracious enough to grant those orders. My ruling is that I will not vary them,” said Justice Junguna.
The judge further urged both parties to now focus on the appeal, reminding them that the 120-day timeline she had previously given officially commenced as of today.
“That’s why I gave 120 days, and for the purpose of the record, the 120 days start from today. It’s on that basis that I said we will not entertain any further applications, so we can concentrate on the appeal and bring the matter to a conclusion,” she stated.
Addressing the prosecution, she added, “Mr. Mutuku, you know the others are still in custody, and you remember Mr. Jenga complaining that the matter is taking too long.”
In July this year, the High Court ordered the release of Waititu upon securing a bank guarantee of Ksh 53 million to facilitate his release from prison.
However, during today’s mention of the case, Waititu’s legal team informed the court that he was facing difficulties in obtaining the bank guarantee. His lawyer requested that the former governor be allowed to deposit Ksh 53 million in cash instead.
The former county boss was convicted in February this year, alongside his wife Susan Wangari, and sentenced to 12 years in prison over corruption-related charges.
