A case in which a petitioner challenging the impeachment of Kisii Deputy Governor Robert Monda had withdrawn his case will be heard today (Tuesday, April 16).
Jared Mairura last week filed a notice of withdrawal before the Nyamira High Court, in what came as a blow to the impeached deputy governor, who had seen some semblance of a lifeline in recapturing his seat.
In his petition on May 20, 2024, Mairura had challenged Monda’s impeachment by the Senate before justice Winfridah Okwany.
But last week, Mairura’s new lawyer Muli Munyaro asked the court to adopt his client’s notice of withdrawing the suite he had filed before Justice Ogolla.
“We are not seeking extension of conservatory or interim orders,” Munyaro told the court.

A lawyer representing the Senate did not oppose the withdrawal application filed by Munyaro.
Ochieng Odinga, lawyer representing Kisii County Government and Governor Simba Arati — pending enjoined application in this matter — told the court to deal with the question of withdrawal before consolidating three other petitions linked to the matter.
Katwa Kigen, lawyer representing the impeached deputy governor also pending enjoinment to the matter, argued stay orders should be maintained. On his part, Erick Theuri representing Wycliffe Siocha — MCA Ichuni ward — said the court should not give any substantive orders.
The case will be heard in a virtual court proceedings today at 2 pm.
