Kenyan-Italian nationals who started fire that razed down KSh667M property in Malindi released on KSh300,000 bond each

A court in Malindi has released Kenyan-Italian national Franco Esposito, alias Kososo wa Baya, and his co-accused Elly Esposito on a personal bond of KSh300,000 after they were arraigned on charges of committing a reckless and negligent act causing harm.

The prosecution alleges that on May 25, 2026, at Siro Land in Malindi Sub-County, Kilifi County, the accused started an open fire and failed to take the necessary precautions to contain it, leading to the destruction of Duma Villa, a property belonging to Nagia Dahmani valued at KSh667 million.

The accused (pictured on the dock) were arrested on July 6, 2026 and arraigned the same day, where they were remanded in custody. The court further ordered the detention of their passports pending the hearing of the case.

In its ruling on bond, the court directed both accused persons to deposit their passports in court as part of the bond conditions.

The prosecution informed the court that investigations into the matter have been completed.

The court further directed that the case be mentioned on July 23, 2026, for further directions as the criminal proceedings continue.

Investigations by the Office of the Director of Public Prosecutions (ODPP) in Malindi have been completed, with the matter now set for hearing. The prosecution has lined up several witnesses, including the complainant, Nagia Dahmani, as well as Samuel Katana, Anderson Mwen, Agnes Mashaka Kaingu, Kingi Karisa, and police officers involved in the investigation.
