Rose Mulwa and her son Chris Mulwa have protested what they termed malicious and unfair treatment by the State, as they appeared in court over the murder of Dr. Victoria Mutiso.

The two asked the court for permission to address When prosecution sought to have the miscellaneous application seeking their continued detention closed.

Their lawyer, Danstan Omari, strongly objected to the closure of the application, arguing that there were serious issues that needed to be addressed.

Omari told the court that the defence had only yesterday challenged the State’s attempt to continue detaining lawyer Angela Mulwa, saying the defence was concerned about the manner in which the prosecution had handled the case.

He said only three people had so far been charged with the murder of Dr. Victoria, while the State indicated that the charge was against the suspects “with others not before the court.”

The lawyer further pointed out that the State had another miscellaneous application in which it was alleged that the person who pulled the trigger had not yet been identified, or that a decision on that suspect had not been made.

Omari said his clients were ready to appear before the High Court and have their day in court, but maintained that they were unhappy with how the State had conducted itself.

“There is malice on the information before the High Court,” Omari told the court.

The prosecution, however, informed the court that the 21 days granted for investigations had lapsed and that the State had now filed a charge sheet before the High Court.

“The 21 days have collapsed. We now have a charge sheet. We therefore humbly request that the miscellaneous application be closed,” the prosecution said.

The State told the court that the information had shifted to the High Court, where the matter had been listed before Justice Kanyi Kimondo for the suspects’ first appearance.

The prosecution asked the court to close the miscellaneous application and allow the case to proceed before the High Court.

The court subsequently marked the miscellaneous files as closed and directed Mulwa and her son to raise their concerns before the High Court.

The two are among those facing charges linked to the murder of Dr. Victoria Mutiso.
