Six individuals have been charged over alleged procurement irregularities involving KSh.50 million set aside for the purchase of land for a proposed health centre in Umoja Lanet Ward, Bahati Sub-County, Nakuru County.

The Office of the Director of Public Prosecutions (ODPP), in a statement published on its X account on Wednesday, August 26, said the accused face 10 charges linked to the procurement process.

Those charged include Nakuru County Chief Officer for Lands, Housing and Physical Planning and Accounting Officer Judyleah Gathoni Waihenya; Acting Director of Supply Chain Management Services Samuel Wachira Gachigi; Departmental Accountant Ann Wangui Muya; Senior Physical Planner Jane Karungari Muriuki; Deputy Director of Administration Sammy Munga Nyagah; and vendor Samuel Githure Maina.

According to the ODPP, the charges include conspiracy to commit an economic crime, engaging in a project without prior planning, wilful failure to comply with procurement laws, forgery and abuse of office.

The prosecution alleges that the six conspired between October 2019 and October 2020 in connection with Tender No. NCG/DP/LHPP/05/2019/2020 for the acquisition of land for the health facility.

The ODPP further alleges that the project was undertaken without prior planning and that procurement requirements were not followed, including requirements concerning availability of funds.

Five of the accused were arraigned in court and denied the charges, while the sixth is expected to take plea at a later date.

The five were each released on a KSh.2 million bond with one surety of a similar amount, or a cash bail of KSh.250,000.

The ODPP said the matter will return to court on September 23, 2026, for further directions.

The prosecution maintains that the charges arise from alleged irregularities in the handling of public funds. The accused persons remain innocent unless proven guilty by a court of law.
