A Mavoko court has ordered the release of lawyer Angela Mulwa after declining a prosecution application to detain her for a further seven days as the Director of Public Prosecutions (DPP) considers whether to charge her over an allegedly stolen vehicle linked to the murder of Dr Victoria Mutiso.
The prosecution had sought an additional seven days in custody, arguing that although investigations had been completed, the Office of the Director of Public Prosecutions was yet to communicate its decision on whether Mulwa should be charged.
The application was opposed by Mulwa’s lawyers, Danstan Omari and Cliff Ombeta, who argued that investigators had already indicated that there were no further investigations to be conducted.
In its ruling, the court said the decision on whether to charge Mulwa rests with the DPP and that it would not interfere with the prosecutorial mandate.
However, the court found that the prosecution had failed to demonstrate sufficient grounds to justify keeping Mulwa in custody for an additional seven days. The court noted that custodial orders are intended to facilitate legitimate investigations.
The court consequently declined the prosecution’s application and vacated the existing custodial orders against Mulwa.
Mulwa was released on a Sh1 million bond and ordered to surrender her passport to the court. She was also barred from leaving the court’s jurisdiction and directed to report to the investigating officer at Mavoko whenever required or until further orders of the court.
The matter will be mentioned on August 26, 2026.
