The Office of the Director of Public Prosecutions (ODPP) has charged four high school boys over the alleged gang defilement of a 17-year-old girl in Homa Bay County.

According to a statement shared by the ODPP on its official X account on August 6, the four minors were charged with gang defilement contrary to Section 10 of the Sexual Offences Act No. 3 of 2006.

The prosecution told the court that the alleged offence occurred on July 30, 2026, in Rangwe Sub-County, Homa Bay County.

“The accused, jointly and in turns, intentionally and unlawfully defiled the victim,” the prosecution stated.

The four minors appeared before Chief Magistrate Mary Immaculate Gwaro, where they denied the charge.

“The accused pleaded not guilty before Chief Magistrate Mary Immaculate Gwaro and were remanded at the Homa Bay Child Protection Unit pending trial,” the ODPP said.

The case will be prosecuted by Prosecution Counsel Jacinta Moenga, who is expected to present the prosecution’s case when the matter comes up for hearing later this month.

“Prosecution, led by Prosecution Counsel Jacinta Moenga, will present its case from the 22nd of August 2026,” the ODPP added.

The case is expected to proceed in accordance with the provisions of the Sexual Offences Act and Kenya’s child justice framework, given that all the accused are minors. As the proceedings continue, the identities of both the complainant and the accused remain protected under the law.

The charges mark the latest prosecution involving alleged sexual offences against minors, with the ODPP reiterating its role in pursuing justice through the courts.

The trial will determine the culpability of the accused based on the evidence presented, following their plea of not guilty.

The matter is scheduled for mention and further hearing on August 22, 2026.
