Relief for ex-Governor Obado as corruption charges withdrawn

It is a big win for former Migori Governor Okoth Obado after a Nairobi court approved an agreement leading to the withdrawal of corruption charges against him.

In its ruling, the court stated that it had not found any evidence of abuse of power or improper conduct by the Office of the Director of Public Prosecutions (DPP) in reaching the agreement.

“The court has had difficulties finding that there was any abuse of power by the DPP,” the judge ruled.

The court further held that the agreement had satisfied the legal threshold required and formally adopted it, paving the way for the withdrawal of all charges under the relevant provisions of the law.

“The agreement has surmounted the legal test required, and this court hereby adopts the same,” the court ruled.

Consequently, all charges against Obado were withdrawn under Section 87(a) of the Criminal Procedure Code.

EACC undertook investigations in this case after receiving allegations that Migori County Government had made suspicious payments to multiple companies, totalling KSh1.98 billion.

After investigations, most payments were found to have been lawfully made in respect to executed contracts whose works were confirmed in a verification exercise.

However, payments amounting to KSh235 million remained unexplained and were deemed to have been fraudulently acquired from the County Government.
