Court releases man on KSh100,000 cash bail over KSh35 million land forgery case

A Milimani Chief Magistrate’s court has released Mohamed Abdi Mohamed on a cash bail of KSh100,000 after he was arraigned facing multiple charges related to fraudulent acquisition of a parcel of land in Nairobi’s Runda area.

Trial Magistrate Daisy Mutai granted the accused bail after he pleaded not guilty to five counts, including forgery, making false documents, and uttering false documents, all concerning land parcel LR No. 12672/173 IR 89485.

The prosecution alleges that on or before May 3, 2006, at an unknown place within Kenya, Mohamed, jointly with others not before the court, with intent to defraud Margaret Mwikali Katuse, forged a certificate of grant for the land measuring approximately 0.2412 hectares.

The document purportedly contained a third entry indicating a transfer to himself, claiming it was a genuine document issued by the registrar of titles, George Gichimu Gachihi.

In count two, the prosecution alleges that on or before April 19, 2006, Mohamed made a false sale agreement purporting to have been signed by Katuse.

Two additional counts relate to uttering false documents.

It is alleged that on June 2, 2021, at the DCI headquarters along Kiambu Road, Mohamed presented both the forged land transfer document and the sale agreement to Moses Mwenda, a police officer attached to the DCI, claiming they were genuine.

The land in question is valued at approximately Sh35 million, according to court documents.
