“If justice is served, we shall be grateful; if not, we’ll appeal,”- Gachagua ahead of impeachment verdict

Former Deputy President Rigathi Gachagua has asked Kenyans to pray for him ahead of a High Court ruling on his impeachment case, while maintaining that he is prepared to pursue further legal action if the verdict does not go in his favour.

Speaking during a church service at PCEA Muteero Church in Karen, Nairobi, on Sunday, June 7, Gachagua said he remained hopeful that the judiciary would deliver justice in a case he insists was handled contrary to the Constitution and the law.

“I was removed from office against the law and against the Constitution. Tomorrow the case will be decided, so I ask you to pray for me. We are ready for whatever outcome,” Gachagua said.

The Democracy for the Citizens Party (DCP) Leader expressed confidence in the courts, saying he believed the judiciary would independently and impartially determine the matter.

“If the three judges rule that we were treated unfairly and against the law and Constitution, and lift the impeachment, we shall be grateful to God and grateful that there is a justice system in Kenya that works. I have confidence that our judiciary is independent, impartial and will give justice to Rigathi Gachagua and millions of his supporters across the country,” he added.

However, Gachagua said an unfavourable ruling would not mark the end of the legal battle, noting that he was ready to pursue all constitutional avenues available to him.

“If the ruling goes the other way, it is still okay. We will have an opportunity to go to the Court of Appeal and follow the legal remedies provided by the Constitution,” he said.

He also appealed to his supporters across the country to remain calm and peaceful regardless of the outcome of the case.

“I want to urge my supporters across the country, irrespective of the outcome, to remain calm and peaceful. Rigathi Gachagua is a very peaceful person, and I want to ask our supporters to be peaceful and calm,” he said.

A three-judge High Court bench comprising Justices Eric Ogola, Anthony Mrima and Frida Mugambi is expected to deliver its judgment on Monday, June 8, in a case challenging Gachagua’s October 2024 impeachment.

Gachagua is contesting the legality of his removal from office, arguing that Parliament violated constitutional procedures, rushed the process and failed to conduct adequate public participation. He is seeking to have the impeachment declared unconstitutional.

The ruling is expected to set an important legal precedent on the constitutional process for removing a Deputy President from office and could have far-reaching implications for Kenya’s governance and constitutional law.
