Man, 22, slapped with 7 years jail term for attempted rape of 48-year-old woman

A 22-year-old man was on Wednesday, March 27 sentenced to serve seven years in jail after being found guilty of attempting to rape a 48-year-old woman.

In her judgment, Mombasa Senior Resident Magistrate Gladys Ollimo indicated that the prosecution had proven the case against Stephen David Muasya to the required legal standards.

Magistrate Ollimo further noted that the five prosecution witnesses, including the horrified woman, gave corroborative testimonies against the convict.

The court dismissed Muasya’s claim that he was framed up as an afterthought and unrealistic.

The court ruled that the weight of the case tilted in favour of the prosecution, represented by Prosecution Counsel Hilary Isiaho, after the accused failed to unshackle himself from the heinous offence.

The particulars are that on 9th February, 2023 at Consolata area in Likoni Sub-County within Mombasa County, he unlawfully and intentionally attempted to rape the complainant, contrary to Section 4 of the Sexual Offenses Act No. 3 of 2006.

During the trial, the court heard that the accused attacked the woman as she walked home from dropping her daughter off at the school.

The court ruled that the seven-year sentence will serve as a deterrent measure amid the prevalence of sexual and gender-based crimes in the society.
