UK-based council petitions EACC, KRA over alleged eCitizen financial irregularities

The Justice and Equity Council Kenya (UK Chapter) has formally initiated enforcement action proceedings over alleged financial irregularities linked to the government’s eCitizen platform and certain public fundraising activities.

In a statement, the Council confirmed that it has submitted detailed complaints to the Ethics and Anti-Corruption Commission (EACC) and the Kenya Revenue Authority (KRA), citing credible audit findings and publicly documented financial patterns that raise concerns of potential economic crimes, unlawful enrichment, and financial impropriety.

The complaint to the EACC is anchored on findings by the Auditor-General, which point to significant discrepancies in the management of funds within the eCitizen platform.

Among the concerns raised are approximately KSh 2.57 billion in unaccounted funds, suspected diversion of public resources through irregular channels, payments made outside established contractual frameworks, and broader governance failures that may have enabled misuse of public finances.

According to the Council, if substantiated, these issues could amount to violations of the Constitution of Kenya (2010), the Anti-Corruption and Economic Crimes Act, and the Public Finance Management Act.

Meanwhile, the Council has called on the KRA to conduct a forensic review into the origin, legality, and tax compliance of substantial public donations and fundraising initiatives.

The review is expected to determine whether the funds were derived from lawful and declared income, whether all applicable taxes were paid, and whether the transactions could constitute proceeds of crime or unexplained wealth.

The Council emphasised that its actions are not politically motivated but are grounded in the need to uphold accountability and transparency in public financial management.
