The High Court has certified as urgent a contempt of court application seeking to have the Attorney General and Health Cabinet Secretary Aden Duale cited for allegedly disobeying court orders related to the implementation of health sector directives on Ebola quarantine measures.
Justice P. M. Nyaudi ordered that the application be given priority, underscoring the need to safeguard the authority and integrity of judicial proceedings.
The application, dated June 10, 2026, was filed by Katiba Institute, which claims that both the Attorney General and the Health CS failed to comply with court directives issued on May 28 and June 2, 2026.
Through lawyer Malidzo Nyawa, the institute argues that the respondents’ actions amount to contempt of court and undermine the rule of law.
In his directions, Justice Nyaudi emphasized the importance of preserving the sanctity of court processes, stating that the matter warranted urgent consideration.
The court directed the petitioner to serve the application on the respondents immediately, and no later than the close of business on June 12, 2026. The Attorney General and the Health CS have been ordered to file their responses within 24 hours of being served, and in any case, not later than June 15, 2026.
Additionally, the petitioner was granted leave to file a supplementary affidavit by June 16, 2026.
The matter is scheduled for mention on June 16, 2026, when the court is expected to give further directions regarding the contempt proceedings.
