A 92-year-old man has been sentenced to life imprisonment after he was found guily of defiling a 10-year-old child in Mukurwe-ini, Nyeri County.

Samuel Kimiti Ndoro was sentenced to life imprisonment on 10th of September 2026 by Hon. Agde Savai Eddah, the Principal Magistrate at Mukurwe-ini Law Courts.

Ndoro faced one count of defilement contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act No. 3 of 2006. He faced an alternative charge of committing an indecent act with a child contrary to Section 11(1) of the Act.

Prosecution, led by Principal Prosecution Counsel Ms. Elizabeth Waruguru and Prosecution Counsel Ms. Sarah Kitui established that Ndoro, who was known to the child and was a family friend, led her to a secluded area within his compound, where he sexually assaulted her. He subsequently gave her money and threatened her against disclosing the incident.

The matter came to light after Ndoro, fearing that the child would disclose the assault to her grandmother, reported her to the grandmother, alleging that she had stolen from him. When the grandmother confronted the child about the money in her possession, the child disclosed that it had been given to her by Ndoro after the assault. She also disclosed an earlier incident in which she said she had been defiled by the accused.

Prosecution called five witnesses and presented medical and other evidence, including the balance of the money allegedly given to the child, after she acknowledged that she had spent part of it.

Hon. Agade found the child’s evidence credible and sufficiently corroborated, and established that she had positively identified Ndoro as the person who assaulted her.

The court also rejected the accused’s defence, noting inconsistencies in his account and finding that his evidence did not raise reasonable doubt against the prosecution’s case.

Having considered the totality of the evidence, the court found Ndoro guilty of defilement and sentenced him to life imprisonment. The sentence takes effect from the date he was first arraigned and detained.
