Man sentenced to 20 years for defiling 14-year-old in Taita-Taveta

A man convicted of defiling a 14-year-old girl in Taita-Taveta County has been sentenced to 20 years in prison after the prosecution successfully proved the case against him.

According to the Office of the Director of Public Prosecutions (ODPP), Musyoka Paul was convicted of defilement contrary to Section 8(1) as read with Section 8(3) of the Sexual Offences Act No. 3 of 2006. He had also faced an alternative charge of committing an indecent act with a child.

The offence was committed on diverse dates in August 2023 at Chumvini Village in Taita-Taveta County.

The court heard that the minor was walking home from a shopping centre when she encountered Musyoka by the roadside. She told the court that he was armed with a knife and allegedly forced her to the ground before sexually assaulting her.

The minor further testified that Musyoka threatened to kill her during the incident.

She also told the court that on another occasion, she encountered him while returning from the toilet. According to her testimony, he again confronted her with a knife and sexually assaulted her.

The prosecution, led by Charles Mogaka and Louane Lwane, called four witnesses, including the minor, to testify on the circumstances surrounding the offences.

Taveta Senior Principal Magistrate Cecilia Kithinji found that the prosecution had proved its case beyond reasonable doubt before sentencing Musyoka to 20 years in prison.

The ODPP said the court granted the convict 14 days within which to appeal.
